1. Introduction

These Terms and Conditions (“Terms”) govern your access to and use of Lensa’s websites, landing pages, online stores, content, products, customer-support channels, and related services collectively referred to as the “Services.”

In these Terms, “Lensa,” “we,” “us,” and “our” refer to Infinity Creations LLC. “You” and “your” refer to the person accessing the Services or purchasing a product.

By accessing the Services, creating an account, or placing an order, you agree to these Terms and the policies incorporated into them, including our:

If you do not agree to these Terms, do not use the Services or place an order.

Nothing in these Terms excludes or limits any consumer right that cannot legally be excluded or limited.

2. Eligibility

You must be legally capable of entering into a binding contract to place an order.

If you have not reached the age of legal majority where you live, you may use the Services only with the involvement and authorization of a parent or legal guardian.

By using the Services, you represent that:

You are legally permitted to use the Services;
The information you provide is accurate and complete;
You will use the Services only for lawful purposes; and
Your use of the Services will comply with these Terms and applicable law.

3. Customer Accounts

You may be permitted to create an account.

You are responsible for:

Providing accurate and current information;
Keeping your login credentials confidential;
Restricting access to your account and devices; and
All activity performed through your account, except where caused by Lensa’s failure to apply legally required security measures.

You may not sell, transfer, assign, or license your account to another person.

We may suspend or restrict an account where reasonably necessary to protect customers, prevent fraud, investigate unlawful activity, or enforce these Terms.

4. Products and Product Information

We make reasonable efforts to describe and display our products accurately.

However:

Colors may appear differently depending on your screen and device;
Packaging may be updated without materially changing the product;
Measurements may be approximate;
Minor design variations may occur between production batches; and
Product photographs may include staging items that are not part of the purchase.

The contents of your purchase are determined by the product description and order summary displayed at checkout.

We may modify, discontinue, or limit the availability of a product, offer, or quantity at any time. Such changes will not affect an order already accepted by Lensa unless required for safety, legal compliance, or circumstances beyond our reasonable control.

If a material product change affects an accepted order, we will contact you and provide the options required by applicable law.

5. General Wellness Product

Lensa products are intended for general personal wellness use. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition.

Information available through the Services is provided for general informational purposes. It is not medical advice, diagnosis, or treatment and should not be treated as a substitute for advice from a qualified professional.

Individual experiences may vary. Testimonials and customer reviews describe individual experiences and do not guarantee that every customer will obtain the same result.

Do not disregard professional advice or delay seeking appropriate assistance because of information presented through the Services.

6. Safe and Proper Use

You agree to:

Read all instructions, warnings, and safety information before using a product;
Use the product only for its intended purpose;
Follow the recommended setup, usage, cleaning, storage, and maintenance instructions;
Keep electrical components away from conditions not permitted by the instructions;
Stop using the product if it appears damaged, unsafe, or malfunctioning; and
Contact Customer Support if you have questions about safe operation.

You must not:

Modify, dismantle, or attempt an unauthorized repair;
Use damaged electrical components;
Use the product contrary to the supplied instructions;
Allow children to operate the product without appropriate adult supervision; or
Use the product in any unlawful, unsafe, or unintended manner.

Damage caused by misuse, neglect, unauthorized modification, improper storage, or use contrary to the instructions may not qualify for a refund, replacement, or commercial warranty remedy, except where applicable law provides otherwise.

7. Orders and Contract Formation

Placing an order constitutes an offer to purchase the selected products.

After you place an order, we may send an acknowledgment confirming that we received it. This acknowledgment does not necessarily mean the order has been accepted.

An order is accepted when we:

Send an order-confirmation email;
Capture or authorize payment; or
Begin fulfilling the order,

whichever occurs first under the applicable checkout process.

We reserve the right to refuse or cancel an order where reasonably necessary, including when:

A product is unavailable;
Payment cannot be authorized;
Fraud or unauthorized activity is suspected;
The order contains an obvious pricing or description error;
Purchase limits have been exceeded;
The order appears intended for unauthorized resale;
The shipping destination is unsupported; or
Accepting the order would violate applicable law.

If we cancel an order after payment has been collected, we will refund the cancelled amount to the original payment method.

8. Order Information

You are responsible for reviewing your order before submitting it.

You must provide accurate:

Contact information;
Billing information;
Shipping information; and
Payment information.

Contact Customer Support promptly if you identify an error.

We cannot guarantee that an order can be modified after it has entered processing or fulfillment.

Requests to cancel an order are governed by our Return and Refund Policy.

9. Personal Use and Resale

Products purchased through the Services are intended for personal or household use unless we agree otherwise in writing.

You may not purchase products for:

Unauthorized commercial resale;
Redistribution;
Export in violation of applicable law;
Reverse engineering for commercial purposes; or
Fraudulent or unlawful activity.

We may limit quantities, refuse orders, or cancel orders that reasonably appear to violate this section.

10. Prices, Taxes, and Payment

Prices are displayed in the currency identified during checkout.

Unless expressly stated otherwise, prices may exclude:

Applicable sales tax;
Value-added tax;
Shipping charges;
Customs duties;
Import charges; and
Other government-imposed fees.

The checkout page will show the charges collected by Lensa before you submit the order.

Where taxes or duties are not collected at checkout, the recipient may be responsible for paying them directly to the appropriate authority or carrier. The applicable Shipping Policy or checkout notice will indicate when duties and taxes are included.

By submitting payment information, you represent that:

The information is accurate and complete;
You are authorized to use the selected payment method; and
The payment provider may charge the total displayed at checkout.

We may use third-party payment processors. Their processing of payment information is also subject to their applicable terms and privacy notices.

11. Pricing and Website Errors

We try to ensure that product descriptions, prices, discounts, availability, and offers are accurate.

If an obvious error affects your order, we may:

Contact you for confirmation;
Correct the error before accepting the order; or
Cancel the affected order and issue a refund.

We will not retroactively increase the price of an accepted order without your agreement.

Promotional prices and discounts may be subject to separate conditions, including eligibility requirements, expiration dates, product restrictions, and quantity limits.

12. Promotions, Discounts, and Complimentary Items

Promotional codes:

Must be used according to their stated conditions;
May expire;
May apply only to selected products or customers;
May not be combined unless expressly permitted;
Have no cash value; and
May be limited to one use per customer, order, household, or account.

We may cancel or refuse a promotion where we reasonably determine that it has been used fraudulently, unlawfully, or contrary to its disclosed terms.

Complimentary or promotional items included with an offer are subject to the applicable Return and Refund Policy. Unless expressly stated otherwise, they are not independently redeemable for cash.

13. Shipping and Delivery

Processing and delivery estimates are described in our Shipping Policy and during checkout where applicable.

Delivery dates are estimates unless expressly stated as guaranteed.

We are not responsible for delays caused by circumstances outside our reasonable control, including:

Carrier disruption;
Customs processing;
Severe weather;
Natural disasters;
Labor disruption;
Government action;
Incorrect customer information; or
Other force-majeure events.

However, this does not limit any right you may have if we fail to deliver within a legally required or agreed period.

Risk of loss or damage transfers to you when the order is delivered to you or to a person you designated to receive it, except where applicable law provides otherwise.

If you independently appoint a carrier that was not offered by Lensa, risk may transfer when the order is delivered to that carrier, to the extent permitted by law.

14. Returns, Refunds, and Commercial Money-Back Guarantee

Returns, cancellations, refunds, damaged-product claims, inspections, and exchanges are governed by our Return and Refund Policy.

The duration of Lensa’s commercial Money-Back Guarantee depends on the offer purchased:

A Lensa device with its included array receives a 30-day Money-Back Guarantee;
Each additional device or additional array adds another 30 days; and
The total Money-Back Guarantee is limited to 90 days.

The complete eligibility requirements and return procedure are stated in the Return and Refund Policy.

Lensa’s commercial Money-Back Guarantee is separate from any mandatory statutory rights available under applicable consumer law.

15. European and UK Consumer Rights

If you are a consumer in the EEA or UK, nothing in these Terms limits rights that cannot legally be waived.

Depending on your location, these rights may include:

A statutory right to withdraw from an eligible distance purchase within 14 days;
Legal remedies when goods are faulty, damaged, or not as described;
Repair or replacement rights;
A price reduction or refund where repair or replacement is unavailable or unsuccessful; and
Mandatory legal-guarantee rights.

For consumers in the European Union, goods generally carry a minimum two-year legal guarantee of conformity beginning on delivery. National laws may provide longer or additional protection.

Lensa’s commercial guarantees do not replace, restrict, or reduce these statutory rights.

Instructions for exercising applicable withdrawal and return rights are contained in our Return and Refund Policy.

16. Intellectual Property

The Services and their contents—including text, designs, graphics, photographs, videos, audio, logos, product names, software, code, layouts, trademarks, and other material—are owned by or licensed to Lensa and are protected by applicable intellectual-property laws.

Subject to these Terms, Lensa grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes.

You may not, without prior written authorization:

Copy, reproduce, distribute, republish, or publicly display protected content;
Modify or create derivative works;
Use content for commercial purposes;
Remove copyright, trademark, or ownership notices;
Frame or mirror the Services;
Extract or compile product data;
Use Lensa branding in a misleading manner; or
Suggest an affiliation, sponsorship, or endorsement that does not exist.

No right or license is granted except as expressly stated in these Terms.

17. Reviews, Feedback, and User Content

You may be able to submit reviews, feedback, photographs, videos, comments, ideas, or other content (“User Content”).

You retain ownership of your User Content.

By submitting User Content, you grant Lensa a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt, publish, translate, display, distribute, and use that content in connection with operating, improving, and promoting Lensa and the Services.

Where required by applicable law, we will obtain additional permission before using a person’s name, image, likeness, testimonial, or other protected attribute in advertising.

You represent that:

You own or control the necessary rights to the User Content;
The User Content is truthful and based on a genuine experience where presented as a review;
You have disclosed any incentive or material connection;
The User Content does not violate another person’s intellectual-property, privacy, publicity, or other rights;
The User Content is not defamatory, threatening, obscene, fraudulent, or unlawful; and
The User Content does not contain malicious code.

We may moderate, decline, or remove User Content that violates these Terms or applicable law. We are not required to publish every submission.

18. Third-Party Tools and Services

The Services may provide access to tools, applications, payment options, review platforms, social-media features, or other services operated by third parties.

Third-party services may be governed by their own terms and privacy policies.

To the extent permitted by law, Lensa is not responsible for independent third-party services that we do not control. This provision does not limit Lensa’s responsibility for providers acting on our behalf where applicable law makes us responsible.

19. Third-Party Links

The Services may contain links to third-party websites.

We do not control independent third-party websites and are not responsible for their content, availability, products, security, or privacy practices.

Review the third party’s applicable policies before providing information or completing a transaction.

A link does not necessarily constitute an endorsement by Lensa.

20. Relationship With Shopify

Our online store and checkout are powered by Shopify.

Purchases made through our store are transactions between you and Lensa, not between you and Shopify.

Shopify provides ecommerce technology and may process information as described in our Privacy Policy and Shopify’s own privacy documentation.

Shopify is not the seller of Lensa products and is not responsible for fulfilling Lensa orders, providing Lensa Customer Support, or administering Lensa’s commercial guarantees.

Nothing in this section excludes any responsibility that cannot legally be excluded.

21. Privacy

Our collection and processing of personal information are described in our Privacy Policy.

By using the Services, you acknowledge that you have received access to the Privacy Policy. Where consent is legally required, acknowledgment of this policy does not replace consent.

22. Acceptable Use

You may not use the Services to:

Violate applicable law;
Infringe intellectual-property or privacy rights;
Commit or facilitate fraud;
Submit false or misleading information;
Impersonate another person or entity;
Harass, threaten, abuse, or harm another person;
Transmit malware or harmful code;
Interfere with the security or operation of the Services;
Circumvent access restrictions;
Conduct unauthorized scraping or data extraction;
Collect personal information about others without authorization;
Send spam or unauthorized marketing;
Test vulnerabilities without written permission; or
Use automated systems in a manner that places an unreasonable burden on the Services.

Standard search-engine indexing and other activity expressly authorized by Lensa are not prohibited.

We may take reasonable technical or legal measures to prevent prohibited use.

23. Suspension and Termination

We may suspend or terminate access to all or part of the Services when reasonably necessary because of:

A material violation of these Terms;
Fraudulent or unlawful activity;
Threats to the security or operation of the Services;
Abuse of customers, staff, or service providers;
Legal or regulatory requirements; or
Discontinuation of the relevant Service.

Where appropriate and legally required, we will provide notice and an opportunity to address the issue.

Termination does not affect rights or obligations that arose before termination.

Sections that by their nature should continue—including intellectual property, User Content, disclaimers, liability provisions, governing law, and dispute provisions—will survive termination.

24. Disclaimer of Website Warranties

The website, digital content, and online functionality are provided on an “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

The Services will always be uninterrupted or error-free;
Every defect will be corrected immediately;
The Services will be free from all harmful components; or
Every piece of general information will be complete or suitable for every individual purpose.

This section applies to the website and digital Services. Product warranties, commercial guarantees, and statutory consumer rights are governed by the applicable product terms, Return and Refund Policy, written warranty, and mandatory law.

Nothing in these Terms excludes an express written product warranty or any implied warranty that cannot legally be excluded.

25. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

Death or personal injury caused by negligence where such liability cannot be excluded;
Fraud or fraudulent misrepresentation;
Willful misconduct or gross negligence where applicable law prohibits limitation;
Breach of mandatory product-liability law;
Violation of mandatory consumer rights; or
Any other liability that cannot legally be limited or excluded.

To the maximum extent permitted by law, Lensa will not be liable for indirect, incidental, special, punitive, or consequential losses that were not reasonably foreseeable when the contract was formed.

For claims relating to an order, and to the extent permitted by law, Lensa’s total liability will not exceed the amount paid for the product giving rise to the claim.

The preceding limitation does not apply where applicable law requires a different remedy or liability standard.

26. Indemnification

To the extent permitted by applicable law, you agree to indemnify Lensa against third-party claims, losses, and reasonable costs arising directly from:

Your unlawful use of the Services;
Your material violation of these Terms;
User Content that infringes another person’s rights; or
Fraud, intentional misconduct, or unauthorized commercial use by you.

This obligation does not apply to the extent a claim was caused by Lensa’s negligence, unlawful conduct, or breach of these Terms.

This section does not require a consumer to waive a mandatory legal right or assume responsibility prohibited by applicable consumer law.

27. Force Majeure

Lensa will not be responsible for delay or failure caused by events outside its reasonable control, including:

Natural disasters;
Severe weather;
Fire or flood;
War, terrorism, or civil disorder;
Epidemics or public emergencies;
Labor disputes;
Carrier or supply-chain disruption;
Government restrictions;
Utility or telecommunications failures; or
Failures affecting third-party infrastructure.

This section does not remove any right to cancel or receive a refund when applicable law requires one.

28. Governing Law and Disputes

United States customers

For customers residing in the United States, these Terms are governed by the laws of the State of Wyoming and applicable federal law, without regard to conflict-of-law principles.

Any legal proceeding may be brought in a court with lawful jurisdiction over the parties and dispute.

EEA, UK, and other protected consumers

If you are a consumer in the EEA, UK, Switzerland, or another jurisdiction with mandatory consumer protections:

You retain the protection of the mandatory laws of your country of residence;
This governing-law section does not deprive you of those protections; and
You may bring proceedings in any court available to you under applicable consumer law.

Before initiating formal proceedings, you and Lensa are encouraged to contact each other and attempt to resolve the dispute in good faith.

Nothing in this section limits a right to contact a consumer-protection authority, regulator, or competent court.

29. Electronic Communications

When you use the Services or communicate with us electronically, you consent to receiving transactional communications electronically, including:

Order confirmations;
Payment notices;
Shipping updates;
Return and refund communications;
Account notices; and
Updates to agreements or policies where electronic notice is legally permitted.

You are responsible for maintaining a valid email address.

Promotional communications remain subject to separate consent and opt-out requirements.

30. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent.

We may assign these Terms in connection with a merger, acquisition, corporate restructuring, financing, or sale of all or part of our business.

Any assignment will not reduce mandatory consumer rights. Where required by law, we will provide notice before an assignment materially affects you.

31. Severability

If any provision of these Terms is found unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

32. No Waiver

If we do not immediately enforce a provision of these Terms, that does not waive our right to enforce it later.

A waiver is effective only when made in writing by an authorized representative of Lensa.

33. Entire Agreement and Order of Precedence

These Terms and the policies incorporated by reference constitute the agreement between you and Lensa concerning the Services and your purchase.

If documents conflict, the following order generally applies:

Mandatory applicable law;
The specific terms displayed for an offer at checkout;
The applicable Return and Refund Policy or written product warranty;
These Terms; and
Other general website information.

A specific promotional promise or written commercial guarantee will apply according to its stated conditions.

34. Changes to These Terms

We may update these Terms to reflect changes in:

Applicable law;
Our Services;
Our products;
Our business practices; or
Security and operational requirements.

The latest version will be posted on this page with an updated revision date.

Material changes will not retroactively reduce rights attached to an accepted order unless required by law or agreed by you.

Where required, we will provide notice before material changes take effect.

Continued use of the Services after the effective date of updated Terms constitutes acceptance only to the extent permitted by law.
